The Delhi High Court on Thursday rejected a PIL seeking the removal of Arvind Kejriwal from the post of Delhi CM, as per Live Law.
The bench was led by Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora. The bench stated that the petitioner failed to show any bar in the law which prohibits the arrested CM from holding office.
The Chief Justice orally said, “Show us, where is the prohibition? Show us any legal bar which you’re canvassing.”
The ACJ further stated that the court should not get into politics and that it is a matter for the Executive to decide.
The court heard the PIL and observed that since there is no legal bar on Kejriwal to continue in his position as Delhi CM, the court cannot interfere.
The court however said that if there is a constitutional failure then a President or LG will act on it.
Surjit Singh Yadav, a Delhi resident identifying as a farmer and social worker, filed the PIL. Yadav argued that Kejriwal remaining in the chief minister’s position would obstruct due process of law. He further said that it would also disrupt the course of justice. It would also lead to the breakdown of the constitutional machinery in the state.
Earlier on Thursday, Delhi CM Arvind Kejriwal was brought before the Rouse Avenue Court. The ED is seeking additional remand of the Delhi CM.
As per reports, while entering the courtroom Kejriwal said, “This is a political conspiracy and the people will answer it.”
Kejriwal’s wife, Sunita Kejriwal, and son were at the Rouse Avenue court to attend the proceedings. Delhi cabinet ministers Atishi, Saurabh Bhardwaj, Gopal Rai, and several MLAs were also present in the Rouse Avenue Courtroom.
