The Allahabad High Court has declared an order issued by the District Basic Education Officer on 9 August as illegal, which had previously denied 180 days of maternity leave to Kushal Rana, an assistant teacher at Primary School Mundika Mankara in Rampur.
The court has annulled the denial and approved the maternity leave for Rana, directing that her regular salary payments be resumed.
Justice Prakash Padia however issued the ruling while addressing Rana’s petition. The court has mandated that the outstanding dues be paid within six weeks.

Kushal Rana had originally applied for maternity leave to the BSA Rampur. Her request was rejected based on a government order requiring a two-year gap between maternity leaves for two children. The rejection was based on the argument that Rana’s maternity leave request did not comply with this gap requirement.
However, the court noted that this decision contradicts a previous High Court ruling in the Renu Chaudhary case. The court found that the August 9 order was not in line with legal standards and thus invalidated it.
