Allahabad High Court Demands Response On Assistant Teacher’s Pay Scale

High Court Requests Explanation from Basic Education Council

The Allahabad High Court has asked the Basic Education Council to explain why the approved promotional pay scale was not granted to an assistant teacher after 22 years of service. The Basic Shiksha Adhikari (BSA) Prayagraj stated that the pay scale will be given once the seniority list is prepared.

Petitioner Challenges Delay in Receiving Promotion

Justice Prakash Padia issued this order after reviewing the petition from Vijay Kumar, represented by advocates Anurag Tripathi and Rahul Kumar Mishra. Kumar, appointed on February 15, 2000, received the selection pay scale on February 16, 2010, after 10 years. According to a government order from December 20, 2001, assistant teachers qualify for the promotional pay scale after 12 years. The order requires a selection committee, led by the Basic Education Officer, to review and recommend promotions annually. Despite submitting a request to the Basic Education Officer Prayagraj, Kumar saw no action. The High Court directed a prompt decision on this request. The BSA said that the seniority list is being prepared and Kumar will receive the promotional pay scale if included. Kumar argues that no seniority list has been prepared since 2017, although it should be updated every year.
