Allahabad High Court Calls Brothers’ Legal Dispute Over Inheritance ‘Deeply Regrettable’

The Allahabad High Court has expressed deep regret over the inheritance dispute between two brothers involving Rs 2.20 lakh following their father’s death. The court labeled the legal skirmish as deeply regrettable, reflecting on the familial discord that has led to the conflict.

The court drew a stark comparison, recalling the selflessness of Lord Rama’s brother Bharat, and juxtaposed it with what it described as the younger brother’s behavior, likening it to ‘Kaliyug Bharat’.

The dispute centers on the elder brother, Sanjeev Chaddha, who had withdrawn funds from their late father’s joint bank account.

The younger brother, Rajiv Chaddha, a lawyer, had alleged that this withdrawal amounted to criminal breach of trust.

The younger brother also challenged the validity of their father’s will, which reportedly excluded him from any benefits.

Despite efforts by the court to mediate and resolve the issue amicably, the younger brother’s obstinance led to a protracted legal battle.

The case, initially a civil matter, escalated into criminal proceedings intended to pressure the elder brother.

The court deemed the shift unjust, stating that someone had improperly converted the dispute into a criminal case.

Justice Saurabh Shyam Shamsheri, who heard the petition filed by Sanjeev Chaddha, criticized the misuse of legal channels and ordered the dismissal of the criminal proceedings.

The court ruled that there was no evidence of criminal breach of trust and that the charges lacked merit.

Consequently, it annulled the criminal case and imposed a fine of Rs 25,000 on Rajiv Chaddha, directing him to pay this amount to Sanjeev Chaddha within four weeks.

The court observed that while civil disputes can be contentious, turning them into criminal accusations for harassment purposes is unjustifiable.

It also noted that no charge sheet had been filed concerning fraud or a disputed will, further undermining the criminal case’s foundation.
